How is Child Support Determined?

In Florida, there are several factors a judge will consider when determining child support.

Below are the factors used to calculate child support:

  • Each parent’s monthly net income: Florida uses the combined available income of both parents to assess their basic monthly obligation to the children.
  • The eligible children: The more children you have, the higher the support payments will be. However, only children under the age of 18, those who are in high school, or those who have special needs are eligible.
  • The time-sharing arrangement the parents have: The less time a parent spends with the children, the more child support increases. If you spend more time with them, however, the court presumes you are already supporting them enough and will lessen your payments.
  • Child care, dental, and medical costs: Unless your parenting plan addresses these costs separately, medical, child care, and dental costs will all be factored into your child support order.

Your child support order can also be modified if either parent’s financial circumstances change or if the children’s needs change.
